Plans for an adult living community in the Green Valley area of southern Frederick County are on hold again.

The Frederick Board of County Commissioners in two separate decisions Tuesday voted 3-1 to grant a continuance on requests for water and sewer service by attorneys for the 75/80 Dragway property and another 83 acres of adjoining land. The developers of both separate properties are now offering to finance the construction of the future Bush Creek Interceptor in exchange for water and sewer service.

The Bush Creek Interceptor is intended to serve the Frederick County landfill on Reichs Ford Road. The developers of the dragway and the adjoining property are now proposing to finance a connection from the landfill to their properties.

Attorney Krista A. McGowan, representing the 75/80 Dragway, and Bruce N. Dean, the attorney for the H.F. Payne Construction Company, owners of the adjoining property, asked for the delay so they can participate in the building of the interceptor.

Senior housing is proposed for both properties.

Developers had originally hoped to receive water and sewer service from the Monrovia Wastewater Treatment Plant.

But in May, Michael Marschner, director of the county's Division of Utilities and Solid Waste, concluded that there was not enough capacity in the plant to serve the two properties.

The applicants then requested a six-month continuance from the county on their requests. In that time, each did receive approval from the county on their preliminary plans to build age-restricted single-family homes.

"We requested a continuance and since then there has been significant changes down in Monrovia," Dean said. "We planned to use the Monrovia Wastewater Treatment Plant, but now staff has determined there was not enough capacity. My client has agreed to help fund and construct the Bush Creek Interceptor...for 100 senior housing units."

The continuance will allow developers time to resubmit applications based on plans to help finance the interceptor and meet all the requirements needed for water and sewer service.

Commissioners agreed to continue until Nov. 15, 2005.

Commissioner John Lovell Jr. (R) was absent from Tuesday's meeting.

Commission President John "Lennie" Thompson Jr. (R) was the lone vote against the continuance.

In an e-mail on Nov. 11, Thompson indicated to his colleagues that he had concerns that both applicants had "joined forces," to have an advantage over other prospective developers.
